Terms of Service

Please read these terms carefully before using Viewdora’s services.

Effective Date: October 1, 2025

These Terms of Service (“Terms”) govern your use of Viewdora (“Viewdora,” “we,” “our,” or “us”), a service owned and operated by Forged Concepts LLC.

By accessing or using Viewdora’s website, mobile apps, photographer dashboard, or any related services (collectively, the “Services”), you agree to be bound by these Terms. If you do not agree, do not use the Services.

Part A – General Terms (Applies to All Users)

1. Definitions

Account: A registered user profile used to access the Services.

Photographer: A professional or organization using the Services to upload, manage, and share images.

Client: An end user invited by a Photographer to view, select, or download photos.

Content: Photos, videos, text, data, and materials uploaded or created through the Services.

Subscription: A paid plan that provides access to premium features.

Third-Party Services: External tools (e.g., AWS, Stripe, Stytch) integrated into the platform.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction). If you are under 18 years of age and desire to establish your own Viewdora account, please have your guardian contact us at hello@viewdora.com to discuss permissible use options for minors.

If you are using the Services on behalf of a company, you represent that you are authorized to bind that entity to these Terms.

3. License to Use

Viewdora grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for lawful purposes and in accordance with these Terms.

4. Account Responsibilities

You must:

  • Provide accurate, current information.
  • Keep your credentials confidential.
  • Accept responsibility for all activity on your account.

We may suspend or terminate accounts that violate these Terms or applicable law.

5. Account Deletion

If you wish to permanently delete your account and associated data, you must contact us directly at hello@viewdora.com.

  • Verification may be required to confirm account ownership.
  • Once confirmed, your account and associated content will be deleted from active systems within 30 days.
  • Deleted accounts cannot be recovered.
  • Some records may be retained as required by law or for legitimate business purposes (e.g., billing or fraud prevention).

6. Acceptable Use

You agree not to:

  • Upload illegal, defamatory, or infringing content.
  • Bypass security features, screenshot protection, or watermarking.
  • Reverse engineer, copy, or redistribute the Services.
  • Upload malware or disrupt the platform.
  • Use Viewdora to host or transmit sensitive personal data (e.g., health, financial, or biometric data).
  • Post or upload any Content that harms minors in any way, including, but not limited to, Content that violates federal and state child pornography laws, child sexual exploitation laws and laws prohibiting the depiction of minors engaged in sexual conduct.

7. Intellectual Property

Your Content: You retain all ownership rights. By using the Services, you grant Viewdora a limited license to host, process, and display your content solely to provide the Services.

Our IP: Viewdora, its software, trademarks, designs, and technology are protected by law. You may not copy or create derivative works.

Feedback: You grant Viewdora a perpetual, royalty-free license to use feedback for improvements.

8. Third-Party Services

We use third-party providers (AWS, Brevo, Stytch, Stripe, etc.) to operate the platform. They may process your data under their own terms. Viewdora is not liable for their actions but ensures they meet industry-standard security practices.

9. Data Protection

Your information is handled per our Privacy Policy. We implement encryption in transit and at rest, access controls, and regular monitoring.

10. Modifications to the Services

We may update, modify, or discontinue any feature at any time. We will make reasonable efforts to notify you of material changes.

11. Fees, Subscriptions, and Payments

  • Prices and features are described on our pricing page or order forms.
  • Subscriptions renew automatically unless canceled.
  • All payments are processed through Stripe or equivalent providers.
  • Fees are non-refundable unless required by law.
  • Taxes and currency conversion fees are your responsibility.

12. Warranties and Disclaimers

  • The Services are provided “as is” and “as available.”
  • We do not warrant uninterrupted, error-free service or that screenshot protection will be fully effective.
  • All implied warranties (merchantability, fitness, non-infringement) are disclaimed to the fullest extent allowed by law.

13. Limitation of Liability

To the maximum extent permitted by law:

  • Viewdora and its affiliates are not liable for indirect, incidental, or consequential damages (loss of profits, data, or goodwill).
  • Total liability is capped at the fees paid in the 12 months before the claim.
  • Some jurisdictions do not allow certain limitations, so they may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless Viewdora, its owners, and affiliates from claims, damages, or expenses arising from:

  • Your use of the Services;
  • Your content or interactions with clients;
  • Violation of these Terms or applicable law

15. Termination

We may suspend or terminate your account for any violation or misuse. Upon termination:

  • Your license ends immediately.
  • Access to content may be disabled.
  • Photographers may download their content within 30 days before permanent deletion.

16. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including outages, natural disasters, or governmental restrictions.

17. Dispute Resolution and Arbitration

  • To resolve disputes efficiently, you agree to first contact us at hello@viewdora.com.
  • If unresolved, disputes will be handled through binding individual arbitration under the rules of the American Arbitration Association, and not in court, unless prohibited by law.
  • You waive the right to participate in class actions or jury trials.

18. Governing Law

These Terms are governed by the laws of the State of Virginia, USA, without regard to conflict-of-law principles.

19. Updates to Terms

We may update these Terms periodically. The new version will be posted with an updated effective date. Continued use after updates constitutes acceptance.

Part B – Photographer Terms (B2B)

1. Use and Responsibilities

Photographers may upload, organize, and share client galleries. You are responsible for:

  • Ensuring you own or have licenses for uploaded content.
  • Obtaining consent from identifiable individuals in photos.
  • Managing client access and permissions.
  • Complying with all copyright and privacy laws.

2. Payments and Billing

  • You authorize Viewdora to charge your designated payment method for all subscription fees.
  • You are responsible for maintaining accurate billing details.
  • Failure to pay may result in account suspension or data deletion.

3. Client Data and Data Processing

Viewdora acts as a data processor on behalf of the Photographer for client data. You are the data controller responsible for ensuring your clients’ privacy rights under applicable laws (e.g., GDPR, CCPA).

4. Termination by Photographer

  • You may cancel your subscription through your account settings.
  • Data and backups will be permanently deleted within 30 days of termination.

Part C – Client Terms (B2C)

1. Access

  • Clients may view, select, or download photos only as permitted by the photographer.
  • You may not redistribute or use photos commercially without the photographer’s consent.

2. Restrictions

Clients agree not to bypass screenshot protection, share unauthorized copies, or alter downloaded photos.

3. Account Management

  • Access credentials are issued by the photographer or Viewdora.
  • We may revoke access for misuse or violations.

4. Responsibility for Content

Photographers are solely responsible for the photos they upload. Viewdora is not liable for the legality, accuracy, or appropriateness of user-generated content.

Part D – Miscellaneous

Assignment: You may not assign these Terms without our written consent.

Severability: If any provision is found invalid, the remainder remains in effect.

Entire Agreement: These Terms constitute the full agreement between you and Viewdora.

Survival: Sections on intellectual property, limitation of liability, and indemnification survive termination.
